Title: Blurred Lines: How the U.S. Constitution Was Bent to Serve Corporations

Introduction:

What happens when legal fiction becomes political reality? This small paper explores how the United States Constitution, a document forged to protect human dignity and liberty, has been co-opted to serve the interests of non-human entities: corporations. The result is a distorted system where rights designed for people are now used to shield economic giants, distorting democracy and public life.

It is worth noting that the U.S. Constitution was not enacted immediately after the country declared independence in 1776. In fact, it took more than a decade; 13 years, to be exact—before the Constitution came into force in 1789. For that entire period, the United States functioned under the Articles of Confederation, a weak and decentralized system that many argue set the stage for later constitutional overreach. That long delay raises serious questions about the urgency, intent, and clarity of the founding legal framework; a point of concern rarely discussed in mainstream discourse.

This delay, coupled with the gradual legal transformation that followed, has led many to believe that what emerged was not merely a product of evolving governance but a clever and deeply troubling scheme. Over time, this structure has been quietly fostered onto the American people, masking corporate power under the guise of constitutional legality. What began as a noble vision of liberty has, in many ways, been repurposed into a system that empowers artificial entities at the expense of real human lives. It is a strategic manipulation; some would say an evil genius-level deception—that has embedded itself into the legal DNA of the nation.

The Nature of the Beast

A corporation is not a person. It has no soul, no body, no heartbeat. It exists solely as a legal invention to limit liability, amass capital, and generate profit. It does not vote, love, suffer, or die. Yet, in the eyes of U.S. constitutional law, it has been granted the status of “person-hood”; a status meant for human beings.

The Constitution Was Meant for People

The U.S. Constitution, particularly the Bill of Rights, was crafted to protect the natural rights of human beings:

Free speech

Freedom of religion

Due process

Equal protection

These are moral, emotional, and political rights rooted in the human experience. Extending them to profit-driven entities distorts their original meaning.

A Legal Trojan Horse

The turning point came in 1886 with Santa Clara County v. Southern Pacific Railroad. Although the Supreme Court did not rule explicitly on corporate person-hood, a head-note suggested that the Court viewed corporations as protected under the 14th Amendment. That footnote became precedent.

Fast forward to Citizens United v. FEC (2010). The Court ruled that corporations have First Amendment rights and can spend unlimited money in political campaigns. This transformed money into speech and corporate treasuries into political weapons.

Oil and Water Don’t Mix

Merging human rights with corporate interests is like mixing oil and water. It leads to:

Subversion of democracy: Wealth, not will, dictates elections.

Distortion of rights: Tools meant to protect the weak now shield the powerful.

Erosion of accountability: Corporations can break laws without facing prison.

Moral confusion: The legal system begins to treat legal fictions as living beings, and human-beings as legal fictions..

The Canadian Contrast

In Canada, Section 7 of the Charter of Rights and Freedoms applies only to natural persons. Canadian courts recognize that rights to “life, liberty, and security of the person” cannot logically apply to corporations. This approach maintains a clear boundary between economic tools and human dignity.

Conclusion: Time for Clarity!

The U.S. has wandered far from the constitutional vision of a government by, for, and of the people. By granting corporations human rights, the law has created a shadow society where the powerful play by very different rules. The path forward requires a reawakening of constitutional purpose: to serve people, not paper-entities.
